Royal Decree 357/1991, of March 15, which develops, in matters of non-contributory pensions, Law 26/1990, of December 20, which establishes non-contributory benefits in the Social Security system. (Official State Gazette No. 69, published on 03/21/1991)
Non-contributory pensions are economic benefits granted to citizens who, being in a situation of need requiring protection, lack sufficient resources for their subsistence under the legally established terms, even if they have never contributed or not for a sufficient time to reach contributory benefits.
Within this category, the following pensions are included:
Non-Contributory Disability, whose main requirements, in addition to lacking sufficient resources, are eighteen or older and under sixty-five, reside in Spanish territory and have done so for a period of five years, of which two must be consecutive and immediately prior to the date of application and have a recognized degree of disability equal to or greater than 65%.
For the year 2016, the minimum pension is €91.98 and the maximum is €367.90 for 14 monthly payments per year.
When it comes to people with a disability of 75% or more, and who need the help of another person to perform the most basic acts of daily life, such as dressing, eating, etc., the pension will be increased by 50% over the maximum amount (€183.95 for the year 2016).
Non-Contributory Retirement Pension whose main requirements, in addition to lacking sufficient resources, are sixty-five years of age or older, reside in Spanish territory and have done so for a period of ten years, in the period between the date of fulfillment of sixteen years and the accrual of the pension, of which two must be consecutive and immediately prior to the date of the application.
The pension, for 2016, is a minimum of €91.98 and a maximum of €367.90 for 14 monthly payments per year.
The Non-Contributory Retirement Pension is incompatible with the Non-Contributory Disability Pension, with Welfare Pensions (PAS) and with the Guarantee of Minimum Income Subsidies (SGIM) and for Third Person Assistance (SATP) contemplated by Royal Legislative Decree 1/2013, of November 29, which approves the Consolidated Text of the General Law on the rights of persons with disabilities and their social inclusion, as well as with the status of being the cause of the Family Allowance for a Dependent Child with a Disability.
