Am I entitled to sick leave and receive payment for it if I am a domestic worker?

Sick leave for domestic workers

Fortunately, today domestic workers, like other workers, have the right to be on sick leave and receive benefits during the time they are on leave due to temporary incapacity.

How much will I receive while on sick leave?

First of all, it should be noted that it depends on the reason for the sick leave.

  1. Sick leave due to work-related contingencies—this would be the case of a work accident or occupational disease (originating from the work activity). The following amounts will be received:
  • On the day of sick leave, the full salary must be received, whether the entire day is worked or not.
  • From the day after the leave begins, 75% of the regulatory base is received.

 

  1. Sick leave due to common contingencies—this would be the case of leave due to a common illness or an accident that is not work-related. These are causes unrelated to work. The following amounts will be received:
  • The first three days are free.
  • From day 4 to 20, 60% of the regulatory base is received.
  • From the 21st onwards, 75% of the regulatory base is received.

The regulatory base will be calculated using the contribution base corresponding to the month prior to the sick leave. If there is no payslip for the previous month, because it is their first month of employment, the regulatory base for that month will be used.

What requirements do I need to meet to receive sick pay?

To be eligible for sick pay, you must be registered with Social Security and, if the leave is due to common illness or injury, have contributed for a minimum of 180 days within the previous 5 years. If, on the other hand, the leave is due to work-related injury or illness, prior contributions are not required.

Who pays for my sick leave?

Everything will depend on the reason for the leave.

1.- In case of common contingencies - common illness or non-work accident - from the 8th day onwards, you have to request direct payment of the sick leave from Social Security.

2.- In case of occupational contingencies - work illness or accident - from the day after the leave, direct payment must be requested from Social Security or mutual insurance company, depending on who the employer has contracted for occupational contingencies.
