Covid measures, 04/06/20

COVID-19. The Order with the flexibility measures in phase 3 of the Plan for the transition to a new normal has been published in the BOE.

The Order SND/458/2020 has been published in the Official State Gazette (BOE) on May 30th, for the relaxation of certain national restrictions established after the declaration of the state of alarm in application of phase 3 of the Plan for the transition to a new normal, with effects from 00:00 hours on June 1, 2020, and which affects the territorial units that move to this phase, specifically now the islands of La Gomera, El Hierro and La Graciosa, and the island of Formentera.

We inform you that the Order SND/458/2020, of May 30, for the relaxation of certain restrictions of national scope established after the declaration of the state of alarm in application of phase 3 of the Plan for the transition to a new normality, with effects from 00:00 hours on June 1, 2020, and will maintain its effectiveness throughout the validity of the state of alarm and its possible extensions.

Since June 1, 2020, 70% of Spanish territory has been in phase 2 of the plan for the transition to the new normal after the coronavirus crisis.

Specifically, the three Valencian provinces, the Bierzo region (Castilla y León), the Andalusian provinces of Málaga and Granada, three health districts in Catalonia, and the municipality of Totana (Murcia), which was in Phase 1 due to a new outbreak, move to Phase 2. Additionally, the islands of La Graciosa, El Hierro, and La Gomera (Canary Islands) and Formentera (Balearic Islands) advance to Phase 3. These are the phases in which each area and province of Spain finds itself:

On Friday, May 23, new measures to ease the lockdown came into effect. In municipalities with 10,000 inhabitants or fewer—almost 90% of municipalities and home to 10% of the population—regardless of the phase they are in, time slots for walks and sports activities have been eliminated, children under 14 can go out accompanied by more than one adult, and open-air markets and the reopening of bars and restaurants are authorized. In the Community of Madrid, children can go for walks from 10:00 a.m. to 1:00 p.m. and from 5:00 p.m. to 9:00 p.m. However, throughout Spain, the use of face masks is mandatory "in public streets, in open-air spaces, and in any enclosed space for public use or that is open to the public, whenever it is not possible to maintain a distance" of two meters.

PHASE 3 MEASURES

In accordance with Order SND/458/2020 for the easing of certain nationwide restrictions established after the declaration of the state of emergency, in application of Phase 3 of the Plan for the Transition to a New Normal, individuals vulnerable to COVID-19 may also make use of the authorizations provided for in this Order, provided their clinical condition is controlled and allows it, and while maintaining strict protective measures.
Individuals who present symptoms or are in home isolation due to a COVID-19 diagnosis, or who are in home quarantine due to close contact with someone with symptoms or diagnosed with COVID-19, may not make use of these authorizations, whether to return to their workplace or to go to the premises, establishments, centers, or carry out the activities referred to in this Order.
Promotion of remote work:
Whenever possible, the continuation of teleworking will be encouraged for those employees who can perform their work remotely.
Notwithstanding the foregoing, companies may develop protocols for the return to in-person work, always in accordance with labor and occupational risk prevention regulations. These protocols must include recommendations on the use of personal protective equipment appropriate to the level of risk, a description of the safety measures to be applied, regulations for staggered work schedules for staff, whenever possible, and provisions for work-life balance.
Measures to prevent the risk of large gatherings of people in the workplace:
Without prejudice to the adoption of the necessary collective and individual protection measures, workplaces must make the necessary adjustments to their work schedules to avoid the risk of large gatherings of people, whether employees or not, in workspaces or centers during peak hours, taking into account the geographical area in question.
A risk of mass gatherings will be considered to exist when there are no reasonable expectations that minimum safety distances will be respected, particularly at workplace entrances and exits, taking into account both the likelihood of mass gatherings of workers and the foreseeable or periodic influx of other people.
The adjustments referred to in the preceding paragraph must be made taking into account the instructions of the competent authorities, as well as, where applicable, the provisions of the relevant labor and collective bargaining regulations.
In addition to introducing hygiene and prevention measures in the workplace, with the promotion of teleworking, the following measures are noteworthy:
