Disappearance of the authorization of Visitors' Books


Law 23/2015, of July 21, Regulating the Labor and Social Security Inspection System.

Article 21.6 of Law 23/2015, of July 21, regulating the Labor and Social Security Inspection system, establishes: “The acting officials shall draw up a written record of each action they carry out during visits to workplaces or verifications made through the appearance of the inspected party at public offices. By Order of the Minister of Employment and Social Security, the facts and actions that must be included in the records, their format, and their submission to the inspected parties will be determined, taking into account that, where possible, electronic means will be used and that no obligations will be imposed on the interested parties to acquire or complete any kind of books or forms for carrying out said records.”

As the article correctly points out, it's important to note that the electronic Visitors' Book for access and use by companies and self-employed workers already registered in the application. Until the Ministerial Order is issued pursuant to Article 21.6 of Law 23/2015, no new registration applications for the electronic Visitors' Book application will be processed.

This electronic Visitors Book system is only operational in the following Autonomous Communities: GALICIA, ASTURIAS, CANTABRIA, LA RIOJA AND NAVARRA.

Another case would be that of companies that have an authorized Visitors' Book. In such cases, the procedures can continue to be carried out in the same books, which will therefore remain available to the officials involved.

Notwithstanding the foregoing, it is recalled that the obligation to keep the exhausted visitor books is in accordance with the provisions of the Resolution of April 11, 2006, on the Visit Book of the Labor and Social Security Inspectorate, in force insofar as it does not contradict or oppose the new Law 23/2015, of July 21.
