From March 7, 2022, companies with between 50 and 100 employees must have an Equality Plan.


 

 

We remind you that the Equality Plan will be mandatory from March 7, 2022 for companies with between 50 and 100 employees.

We remind you that Royal Decree-Law 6/2019 on urgent measures to guarantee equal treatment and opportunities in employment and occupation was published in the Official State Gazette (BOE) on March 7, 2019, which directly impacts equality between women and men, such as extending the requirement to draft equality plans to companies with fifty or more employees.

 

Equality Plan for companies with between 50 and 100 employees

The equality plan is an ordered set of measures, adopted after carrying out a situation diagnosis, aimed at achieving equal treatment and opportunities between women and men in the company and eliminating discrimination based on sex.

The diagnosis prior to the plan is the analysis that will allow the detection of aspects or areas in which situations of inequality or discrimination may be occurring and on which the equality plan must act.

Attention.  We remind you that the Equality Plan will be mandatory from March 7, 2022 for companies with between 50 and 100 employees.

What penalties can a company face if it does not have an equality plan in place?

Failure to prepare and implement an Equality Plan constitutes a serious offense, punishable by a fine of €626 to €6,250. Furthermore, when the obligation to create an equality plan is mandated by the labor authority (Labor Inspectorate), the regulations consider it a very serious offense, and in this case, the penalty can range from €6,251 to €187,515.

In addition to accessory penalties such as the following:

  1. a) Automatic loss of aid, bonuses and, in general, benefits derived from the application of employment programs, effective from the date on which the infringement was committed, and
  2. b) Automatic exclusion from access to such benefits for six months.

Furthermore, under the Public Sector Contracts Law, companies that do not have an equality plan or that do not comply with it will not be able to contract with the Public Administration.
