How to access unemployment benefits for the self-employed in 2023.


 

It is essential to have contributed for at least 12 months for the contingency of cessation of activity, to be up to date with the payment of Social Security contributions and in the case of a definitive cessation of activity, you cannot have exceeded the retirement age which, in 2022 is 66 years and 2 months (66 years and 4 months in 2023) or 65 years if you have contributed for at least 37 years and 9 months.

Self-employed workers who lose their jobs can access unemployment benefits. However, although the measure has been in place since 2015, self-employed professionals must meet a series of requirements to access unemployment benefits in 2023.

Requirements to claim unemployment benefits for the self-employed

It is essential that self-employed workers have contributed for at least 12 months for the contingency of cessation of activity, that they are up to date with the payment of Social Security contributions and in the case of a definitive cessation of activity they cannot have exceeded the retirement age which, in 2022 is 66 years and 2 months (66 years and 4 months in 2023) or 65 years if they have contributed for at least 37 years and 9 months.

To be eligible for the benefit, applicants must have economic, technical, production-related, or organizational reasons, and must demonstrate a 10% loss. Other reasons include force majeure, loss of administrative license, or issues related to divorce or gender-based violence.

They can also access unemployment benefits due to a temporary layoff (ERTE), which is defined as a 60% reduction in the working hours of employees they have on staff. Alternatively, they can access benefits if, in the two previous fiscal quarters, their income or sales have decreased by 75% compared to the same periods of the current year.

Furthermore, they may be eligible for the benefit if they incur debts with their creditors, provided that these debts do not exceed 150% of the ordinary income from sales in the two fiscal quarters prior to the application.

As an essential requirement to apply for the benefit for cessation of activity, you must attach all the documentation that proves your situation and be up to date with your Social Security contributions.
