Intrastat declarations. What is the statistical value?

Port, Port Facility

Following the entry into force of Order HFP/36/2018, of January 18, the recording of the statistical value of tariff items is once again mandatory for all operators.

Intra-community operators required to submit intrastat declarations who do not exceed an annual volume of 6M of intra-community business have been surprised by the obligation to declare the statistical value of goods since the entry into force of the recent Order HFP/36/2018, of January 18.

We are all already familiar with the tax concepts of taxable base, VAT, incidental expenses, shipping, packaging…. But they always correspond to a documented fact, generally with an invoice detailing the price of each service.

The concept of statistical value does not exactly correspond to the algebraic sum of the different taxable bases of the invoices received or issued for an intra-community operation, so what does it refer to?

Concept of statistical value:

  • In the introductions, it is the value of the goods plus the portion of transport and insurance corresponding to the leg from the foreign city of origin to the border crossing where the goods entered Spanish territory; that is, it is the value of the goods at the border. It is equivalent to the concept of CIF value (cost, insurance, and freight)
  • In shipments, it is the value of the goods plus the portion of transport and insurance corresponding to the leg from the Spanish city where the cargo left (i.e., the Spanish border) to the foreign city of destination. It is equivalent to the concept of FOB (free on board) value.

Examples:

  • Goods are received from France worth 6,000 euros with EXWORK delivery terms (made available at the French factory), so the purchase invoice does not include transport and insurance costs; these amount to 650 euros.

The distance between the supplier's factory and the customer is 1,500 km and the distance between the supplier and the Spanish entry border is 825 km.

The calculation to be performed is as follows:

Percentage of km that correspond to the foreign section: 825/1,500 = 55%

Cost of transport and insurance to the border: 650*55%= 357.50

Statistical value: 6,000 + 357.50 = 6,357.50 euros

  • Goods worth €5,000 are shipped to France under CIF delivery terms (the invoice value includes transport and insurance to the customer's address). The transport and insurance cost (included in the price) is €450. The distance between our factory and the customer is 1,500 km, and the distance between our factory and the Spanish border is 675 km.

The calculation to be performed is as follows:

Percentage of km that correspond to the Spanish section: 675/1,500 = 45%

Cost of transport and insurance to the border: 450*45%= 202.50

Statistical value: (5000-450)+202.50= 4,752.50 euros

As we can see, calculating the statistical value is not without its complexities. We must pay attention to issues such as

1. Delivery conditions agreed upon in each transaction (knowledge of Incoterms in foreign trade)

2. Supporting documents for the costs charged to each operation, including the complexity of breaking them down according to the characteristics of the loads (volume, weight, distances, etc.)

If you would like more information, we would be happy to provide it.
