Recording working hours is also mandatory when working remotely.


 

Ensure that employees who work remotely continue to record their working hours. This obligation applies to all your employees, regardless of whether they work outside the office (sales staff, those working abroad, remote workers, etc.) or at the physical workplace.

The coronavirus crisis has made teleworking commonplace, with many companies and workers resorting to this modality to continue with their work activity, but what previously represented a very small percentage is growing more and more, and is predicted to continue doing so.

The fact that homes have become the new offices may lead to a relaxation of timekeeping systems. However, companies are still legally obligated to define shifts, respect breaks, and record the daily performance of all employees, hour by hour.

The courts have already made it clear that even with the implementation of teleworking, it is still mandatory to keep track of employees' working hours. The company is solely responsible for organizing and recording work shifts and this function can never be delegated to the employee.

Attention. Employees who are teleworking have the same rights as on-site employees; and therefore have the right to set working hours, privacy, not to work overtime, etc.

 

Workday Record

The company must record the worker's working hours on a daily basis and total them for the corresponding period in order to pay the workers' wages, and must provide a copy of the summary to the worker, along with the corresponding receipt.

If the employee is part-time, the company must keep a daily record of their working hours. The company's obligation to keep a daily record of working hours for full-time employees only applies if the employee works overtime.

The teleworker's right to have their working hours and rest periods respected by the company remains unaffected, and it is the company's responsibility to implement appropriate workplace risk prevention measures. The company must organize the worker's activities in a way that guarantees rest and compliance with the established limits and duration of their working hours.

 

Don't forget that…

  • Your company is required to record your employees' working hours, indicating the start and end times. If you have employees who work remotely, continue to comply with this recording obligation (make sure your employees clock in).
  • This obligation exists for all its workers, regardless of whether they carry out their activity outside the center (salespeople, those posted abroad, teleworkers…) or in the physical workplace.
  • In the case of teleworking, you can control real working time with some computer program (there are applications that allow the worker to clock in and out of their workday from the computer or from their mobile phone) or even with a manual document signed by the workers themselves.
