Some guidelines to consider when evaluating these models:

1. Compliance programs must be written, clear, precise, and effective.
2. Do not copy programs developed by others, as this raises doubts about the suitability of the model itself and the company's true commitment.
3. Analyze whether the prevention model expresses a corporate commitment that truly deters criminal conduct.
4. Certificates issued by companies or associations do not guarantee the effectiveness of compliance models.
5. Any effective model depends on the support of senior management to instill a culture of compliance throughout the company.
6. Legal entities must be required to ensure that the hiring or promotion of individuals who committed offenses adheres to protocols and procedures that guarantee high ethical standards in the hiring and promotion of managers and employees.
7. Prosecutors should request exemption from punishment, given the evidence of not only the validity of the model but also its alignment with a corporate compliance culture.
8. While the commission of a crime does not automatically invalidate the prevention model, it can seriously call it into question.
9. The firmness of the response in previous situations should be considered positively, and the existence of prior or pending criminal proceedings should be considered negatively.
10. The Compliance Officer must necessarily be a body of the legal entity.
