Royal Decree-Law 4/2023, of May 11, has been published, establishing the prohibition of carrying out certain tasks during the period of highest temperatures, as well as the adaptation of working conditions and the reduction or modification of the hours of development of the planned workday when the State Meteorological Agency issues warnings of orange or red level phenomena.
Royal Decree-Law 4/2023, of May 11 (RDL 4/2023), which came into force on May 13, adopts a set of measures in agricultural and water matters in response to the drought and the worsening of conditions in the primary sector resulting from the armed conflict in Ukraine and the climatic conditions, as well as promoting the use of public land transport by young people and preventing occupational risks in episodes of high temperatures.
Along with other labor and social security measures related to the drought, Royal Decree-Law 4/2023 strengthens legislation on occupational risk prevention in response to the extreme temperatures of recent years. This regulation prohibits certain tasks during periods of highest temperatures and mandates adjustments to working conditions and the reduction or modification of working hours when the State Meteorological Agency (AEMET) issues orange or red alerts for weather events.
These forecasts will affect all workplaces.
Specifically, Royal Decree-Law 4/2023 establishes that when work is carried out outdoors and in workplaces that, due to the activity carried out, cannot be closed:
- Appropriate measures must be taken to protect workers from any risks related to adverse weather conditions, including extreme temperatures.
- The measures will be derived from the occupational risk assessment, which will take into consideration, in addition to the phenomena mentioned, the characteristics of the task being carried out and the personal characteristics or known biological condition of the worker.
- When the proper protection of the worker cannot be guaranteed in any other way, preventive measures will include the prohibition of carrying out certain tasks during the hours of the day when adverse weather phenomena occur.
- When AEMET or, where applicable, the corresponding regional body issues an orange or red level warning of adverse weather phenomena, and the previous preventive measures do not guarantee the protection of workers, it will be mandatory to adapt the working conditions, including the reduction or modification of the hours of development of the planned workday.
