Financial, Legal, 11/02/25

The end of the “Golden Visa” investor residence visa will come into effect on April 3, 2025.

Organic Law 1/2025 on measures regarding the efficiency of the Public Justice Service, leaves articles 63 to 67 of Law 14/2013, of September 27, on support for entrepreneurs and their internationalization, which regulated the residence visa for investors (also known as Golden Visa), without content.

On January 3, 2025, Organic Law 1/2025, of January 2, on measures to improve the efficiency of the Public Justice Service, was published in the Official State Gazette (BOE). This law, which will come into force on April 3, 2025, marks a significant change in the legal framework for investor residence visas, commonly known as Golden Visas.

This law eliminates articles 63 to 67 of Law 14/2013, of September 27, on support for entrepreneurs and their internationalization, rendering ineffective the possibility of requesting these residence permits based on significant investments in Spanish territory.

What were Golden Visas?

The Entrepreneurs Law allowed non-resident foreign citizens to obtain a residence visa through a significant investment in Spain, provided that certain requirements were met:

  • Financial investments: At least 2 million euros in Spanish public debt or 1 million euros in shares of Spanish companies, investment funds, venture capital funds or bank deposits in Spanish entities.
  • Real estate investments: Acquisition of real estate in Spain for a value equal to or greater than 500,000 euros.
  • Business projects: Initiatives of general interest developed in Spanish territory.

With the entry into force of Organic Law 1/2025, these options will no longer be available.

Transitional regime

The regulations include transitional provisions to safeguard acquired rights and pending applications:

  1. Applications submitted before April 3, 2025: Investors or family members of investors who applied for their visa before this date may continue to process it in accordance with the regulations in force at the time of the application.
  2. Visas already granted: Permits granted prior to the entry into force of the law will remain valid for the period for which they were issued.
  3. Renewals: Renewal applications will continue to be processed in accordance with the legal provisions applicable on the date the initial authorization was granted.
