The Reactivation of the Catalan Non-Productive Assets Tax.

If it was published in 2017, why wasn't it being applied?

This tax was challenged by the Spanish government before the Constitutional Court in July 2017, but the High Court ruled in favor of the Catalan government, allowing it to implement the tax. With the approval of Decree Law 8/2019, of May 14, amending Law 6/2017, the regulations were brought into compliance with the Constitutional Court's ruling.

What are the main new features of this decree law?

We can list the following:

  • The new decree regulates, through the modification of article 10, the deadline for submitting the self-assessment of the tax, which is established from June 1 to 30 of each year

 

  • The three years already accrued (2017, 2018 and 2019), which must be settled, in an extraordinary manner, between October 1 and November 30 of this year

 

  • The self-assessment must be submitted electronically, through the electronic headquarters of the Tax Agency of Catalonia

 

  • Amendment to Article 8 for the application of new rates for calculating the tax quota

What was this tax created for?

The Catalan government, on its website Gencat.cat, states: “Thistax, which companies must pay, has an extra-fiscal purpose because it aims to encourage the alignment of the legal ownership of non-productive assets with their actual ownership. In this way, it seeks to achieve income redistribution and, at the same time, combat tax fraud, since it will prevent tax avoidance practices such as incorporating personal assets into corporate structures.”

With the reactivation that has occurred, Catalonia becomes the first autonomous community in Spain to apply a tax of this kind.
