The Labor Inspectorate will again send mass communications to regularize the situation of domestic workers.


 

Following last year's campaign, the Labor Inspectorate is launching a new action plan to regulate wages and social security contributions for domestic workers. This time, the focus will be on part-time employees.

Recently, the Labor and Social Security Inspectorate (ITSS) initiated an Action Plan to regulate the salaries of domestic workers and, consequently, the contributions of these workers, given that their remuneration affects the contribution base of the group.

 

  1. Inspection campaign

The Plan, which is a continuation of the one carried out in 2021 (the year in which more than 45,000 communications were sent, to regularize more than 47,000 employment relationships), again involves a massive mailing of letters addressed to employers, offering them technical assistance and information to regularize salaries that are below the minimum interprofessional wage (SMI).

In 2022, special emphasis will be placed on part-time employees. Last year, 2,351 temporary contracts were converted to permanent ones. In terms of percentages, over 90% of the regularizations resulted in an increase in pay compared to the amount declared before receiving the notifications.

 

  1. How to regularize: communication of the actual salary to the General Treasury of Social Security

The Inspection itself points out that in this employment relationship the salary is agreed between the employer and the employee, and its amount, in cash, cannot be less than the current minimum wage.

Thus, the aforementioned body has reported on the evolution of the indicator in recent years, also taking into account the incidents that affected the year 2021:

 

 

Taking into account the above information, and in order to regulate the wages and contributions of domestic workers, the head of the household has the obligation to communicate the current real wage, always above the level set by the SMI.

If, in any period of the last four years, the salary declared to the General Treasury of Social Security (TGSS) was lower than the minimum wage in force during that period, that salary must also be updated.

 

Monthly or hourly pay

The Inspection distinguishes two situations:

  • If a fixed monthly salary has been agreed upon with the employee, the agreed monthly salary (including the proportional part of any extra payments) will be communicated. This salary cannot be less than the monthly minimum wage or the corresponding proportional part in the case of part-time work.
  • If an hourly wage has been agreed upon (including pay for Sundays, public holidays, annual leave, and the proportional share of two extra payments), the agreed hourly wage must be communicated. This wage cannot be less than the current minimum wage per hour.

 

Communication channels

This information can be communicated to the TGSS through the following channels:

  • Domestic Employment Data Modification Service (http://run.gob.es/sivrri) from Import@ss, Treasury Portal. Access is available via digital certificate, Cl@ve, or SMS if the citizen's phone number has been previously registered with Social Security. This system only applies if the notification refers to the current actual salary, not if it pertains to updating salaries for periods prior to 2021.
  • Request for changes to employer information through the customer service line, which you can access via the following link: http://run.gob.es/ogmubr. Alternatively, you can use a QR code available on the Labor and Social Security Inspectorate website: https://www.mites.gob.es/itss/web/index.html

In any case, a copy of the ID card or identification document and the completed TA.2/S-0138 form (http://run.gob.es/pgoksc) must be attached.

  • Authorized to the RED System (Social Graduates, Management Companies and Authorized Professionals) if it is already available.
